Terms of Service

These terms are an agreement between you and Mikxx IT Solutions, a sole proprietorship of Riyansh Ahlawat based in New Delhi, the operator of Mikxx ("Mikxx", "we", "us"), registered at WZ-43, Begumpur, New Delhi 110086, India. They cover your use of the Mikxx website, app and services at app.mikxx.com (the "Service"). By creating an account or using the Service you agree to them. If you use Mikxx for a business, you agree on its behalf and confirm you may do so.

1. Who can use Mikxx

You must be at least 18 years old and able to enter a binding contract under Indian law. You must give accurate account details and keep your password safe. You are responsible for everything done in your account and workspace, including by teammates you invite.

2. What Mikxx provides

Mikxx lets you build forms and mini apps, publish them at a link, collect responses, take payments from your customers, and act on responses (emails, webhooks). Some features use AI models to draft or suggest content. We may change, add or remove features; we will give reasonable notice before removing something you pay for.

3. Your content and your customers

• You own the forms, apps, lists and responses you create or collect ("Your Content"). You give us a limited licence to host, copy, process and display it only to run the Service for you.
• You are the data controller for the personal data your forms collect from your customers and respondents. Mikxx processes it on your behalf and only on your instructions. You must have a lawful basis and give any notice required by law (including the Digital Personal Data Protection Act, 2023) before collecting it.
• You are responsible for what your forms ask, say, sell and promise, and for dealing with your own customers, including their complaints, refunds and taxes.

4. Acceptable use

You must not use Mikxx to:

• collect passwords, card numbers, CVVs, OTPs, Aadhaar numbers or bank login details through a form, or impersonate a bank, government body or another business (phishing);
• sell or take payment for anything illegal in India, or anything on Razorpay's list of prohibited businesses (for example gambling, adult content, weapons, drugs, crypto, multi-level marketing, or fake or counterfeit goods);
• send spam, malware, or unsolicited bulk messages;
• break the law, infringe anyone's rights, harass, defame or discriminate;
• overload, probe, scrape or attack the Service, or get around its limits or security.

We may remove content, pause forms or payments, or suspend accounts that break these rules, and report illegal activity to the authorities.

5. Payments you collect

Mikxx offers two ways for your customers to pay you:

• Direct UPI. Customers pay your UPI ID directly from their UPI app. The money never passes through Mikxx and we charge no fee. Mikxx only shows a QR code or link and records the UPI reference you confirm. We are not a party to the payment and cannot reverse, refund or trace it.
• Razorpay. Card, UPI, netbanking and wallet payments are processed by Razorpay Software Private Limited, an RBI-authorised payment aggregator. To use it you must complete Razorpay's KYC and accept Razorpay's own terms. Mikxx never sees or stores card, UPI PIN or bank login details. Razorpay settles your share to your bank account (Razorpay Route), less Razorpay's fees and Mikxx's platform fee shown in the app. Settlement times, holds, chargebacks and disputes follow Razorpay's terms.

You are the merchant of record for everything you sell through Mikxx. You must deliver what you sell, honour your own refund and cancellation policy, display it to your customers, and pay your own taxes (including GST). Chargebacks and refunds on your sales are deducted from your settlements or may be recovered from you. Mikxx is a technology platform and not a bank, payment aggregator or escrow agent.

6. Fees

Mikxx keeps a platform fee on Razorpay payments that depends on your plan: 1% on Free, 0.5% on Pro and none on Business. Direct UPI payments never carry a Mikxx fee. Paid plans have their own price. Current fees are shown in the app before they apply. Fees are in Indian rupees and exclusive of GST unless shown otherwise. We will give at least 30 days' notice of any increase. 7. AI features

AI drafts and answers may be wrong or incomplete. Review them before you publish. Nothing is saved or published without your action. What you type to the agent, and the form you are working on, are sent to our AI providers to produce an answer; contact details from responses are not.

You can connect other apps, such as ChatGPT, and approve access to one workspace. A connected app acts for you within your role, and you are responsible for what you ask it to do, including publishing forms. When you ask it to read responses, those answers go to that app under its own terms, so make sure your own privacy notice to respondents allows this. Review what an app builds before you publish it. You can disconnect an app at any time in Settings.

8. Availability and changes

We work to keep Mikxx running but do not promise it will be uninterrupted or error-free. We may do maintenance, and we keep backups, but you should export anything you cannot lose.

9. Ending your account

You can stop using Mikxx and delete your account at any time. We may suspend or close an account for breach of these terms, non-payment, legal requirements or risk to others, with notice where we reasonably can. After closing, we delete Your Content within 30 days except what we must keep by law (for example payment and tax records).

10. Intellectual property

The Mikxx software, design and brand belong to us or our licensors. You may not copy, resell or reverse-engineer them except as the law allows. Feedback you send may be used to improve Mikxx.

11. Disclaimers and liability

The Service is provided "as is". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a purpose and non-infringement. We are not liable for indirect, incidental or consequential loss, lost profits or lost data. Our total liability for any claim is limited to the fees you paid Mikxx in the 12 months before the claim, or ₹5,000 if more. Nothing here limits liability that cannot be limited by law.

12. Indemnity

You will compensate us for claims, losses and costs arising from Your Content, your sales to your customers, or your breach of these terms or the law.

13. Changes to these terms

We may update these terms. If a change is significant we will tell you by email or in the app at least 15 days before it applies. Continuing to use Mikxx after that means you accept it.

14. Law and disputes

These terms are governed by the laws of India. Courts at New Delhi, India have exclusive jurisdiction, subject to any mandatory consumer protection law.
